How We Collect and Use Information

We are committed to protecting your privacy and security and this will explain how we do that. We control the Ultimate Leader series of courses and consulting programs from offices in the United States of America. The use of our Ultimate Leader Online program may not be appropriate or available for use in other countries. When you access this site from other locations you are responsible for compliance with local laws, if and to the extent local laws are applicable.

Outside Sites and Outside Users

The use of the Ultimate Leader Online program and our other products may result in your personal information being shared with others with different privacy policies than we have.  Many of you use the Ultimate Leader Online program as part of an event, job related activity, conference or by invitation from some other person or entity.  Unless you tell us not to, we may provide information obtained during the program process and registration to outside entities and individuals such as employers or sponsors who may have provided the Ultimate Leader Online program access to you or others that gifted the Ultimate Leader Online program to You.  In such instances, the collection and use of your personal information will be governed by the privacy policy applicable to that site and those persons or entities. We do not control the privacy policies, contents or links of those other entities, individuals or sites. We encourage you to review the privacy policies of any third party sites, entities, persons or services before providing any of them with access to your personal information that you give us and before agreeing to allow them to access your information. The engagement of our company and the use of our Ultimate Leader Online program by an employer or third-party consultant, in connection with an event or as a gift to you is solely and wholly that party’s responsibility and the use of your data under such circumstances is subject such parties’ independent privacy policies which may be different than this policy. If you do not know and agree to their privacy policies or to them having access to your Ultimate Leader Online program information provided while taking the course then do not accept their invitation. In that case, you may obtain the Ultimate Leader Online program from us directly and we will not share the information or test results about you with them or anyone else.  In other words, if you take the Ultimate Leader Online program at the invitation of someone else it is with your understanding and express permission that we will share the information and results with them.  If you do so you are subject to their privacy policy that may differ from ours. If you don’t know want them to have your information then tell us and we wont give it to them, but if you don’t tell us not to then we will share information with them.

Personal Identification Data and Ultimate Leader Online Information:

We collect and store personal or other information that you voluntarily supply to us online while using the Site and when you use our Ultimate Leader Online program and use our other products. Generally, this information includes name and e-mail address for registration to enroll in the Ultimate Leader Online program, to receive our free newsletters and name, postal address, and credit card information when purchasing our products. For instance we may collect your Name, Address, Phone Number, Email Address, Username, Password, Job Title, Employer Name and other biographical information (personal Identification data) that you voluntarily give to us when you participate in the Ultimate Leader Online program.  All of this information is provided to us by you.

Thereafter we may contact you at that address(es) and numbers.  We may communicate with you about the Ultimate Leader Online program and personal identification data in our communications with you.

Assessment Data: How and why we collect information

We collect personally identifying information from our users during online registration and online purchasing and as part of the Ultimate Leader Online program itself. When users participate in the Ultimate Leader Online program, they are asked to provide certain information, which we will use to generate results based on our proprietary technology.

Sharing

The data that you provide and the results of our Ultimate Leader Online program may, under certain circumstances, be shared with employers, event sponsors or third parties. Many of our users participate in the Ultimate Leader Online program at the invitation of others who specifically order or gift or otherwise arrange for others to participate in the Ultimate Leader Online program. In such events, unless you tell us not to, we share your Personal Identification Information and Ultimate Leader Online program Information with that third party or their employees, agents or assigns.  Your name will not be publicly disseminated to anyone other than you and the third parties arranging for the assessment without your specific consent. The data will also be shared with third parties when ordered or arranged for by an employer or management consultant or when the Ultimate Leader Online program was provided as part of a conference for a variety of purposes. If, for example, you take the participant in the Ultimate Leader Online program as part of a conference, or for work, or by invitation from somebody else we will share your information provided in the Ultimate Leader Online program and program results with that third party.

By using the Ultimate Leader Online program, you acknowledge and agree that the content provided by you as well as the conclusions and assessment derived therefrom may be used by us for research, innovation, case studies, and commercial purposes (such as in speeches, articles, books, etc.) in our discretion. Your assessment data may be aggregated for research and comparison purposes.

We also use the information we collect from you while you are using the Site and the Ultimate Leader Online program in a variety of ways, including using the information to customize features, improve our assessment tools and advertising that appear on the Site. We also may provide your personally identifying and automatically generated information to third parties, such as marketing partners, service providers and contractors for a variety of purposes. Unless you inform us in accordance with the process described below, we reserve the right to use, and to disclose to third parties, all of the information collected from and about you while you are using the Site in any way and for any purpose, such as to enable us or a third party to provide you with information about products and services. If you do not wish your information to be used for these purposes, you must send a letter to the Online Privacy Coordinator whose address is listed at the end of this Privacy

We collect your information in order to record and support your participation in the activities you select. If you register for a seminar or purchase a product, for example, the information is used to book your place, track your preferences, and to update you on information about our events and products. In addition to the Ultimate Leader Online program, we may ask you to provide certain information about yourself by filling out and submitting an online form. It is completely optional for you to engage in these activities including our Assessments. If you do decide to engage in these activities, however, we may ask that you provide us personal information, such as your first and last name, mailing address (including ZIP code), e-mail address, telephone, credit card, and other personal information. Sometimes, if you do not provide certain mandatory data you will not be able to engage in that activity. In all cases, we will collect personal identification information from you only if you voluntarily submit such information to us. We will also tell you how we use your information or if we share it with another party. Apart from the policies herein, we will never intentionally disclose any personal identification information about you as an individual user to any third party without having received your permission.

When you supply us with your contact information either through the site or product purchases or by taking our assessments, you may receive periodic e-mails, mailings or calls from us with information on new products and services, important issues, or upcoming events. If you wish to be removed from any postal, email, phone, or other lists, please let us know by emailing us at hello@DrMaryKay.com or by mailing the privacy coordinator at the address below. Give us your exact name, email address, mailing address, and phone and your name and other information will be removed from the appropriate lists immediately.

Aggregate Information (non-personal, identifiable)

We share results of our assessments as aggregated demographic information with the general public as part of our research and with our partners and Corporate Affiliates. This type of information is generic demographic data such as the statistical analysis of our Assessment results. This information may be shared with investigators, research teams and strategic partners to help us build a better world with the Assessment.  This information is not linked to any personal, identifiable information when presented to the public.

Affiliates

Affiliates associated through the automated Affiliate system on DrMaryKay.com are not automatically able to access any personal, identifiable information just because they refer someone to DrMaryKay.com or to our company.  The Affiliate system tracks products and the dollar amount spent by you related to an Affiliate only.

Communication From Us

Customer Service

We send all new Ultimate Leader Online program users a welcoming email to verify password and username. We communicate with users on a regular basis to provide requested services and in regards to issues relating to their account.  We may reply via email and/or phone, in accordance with the users wishes. Users may select or unsubscribe from certain methods of communication.

Newsletters and Blogs and Emails

We have a newsletter, blogs and emails that we use to communicate with users. If a user subscribes to our newsletter, we get contact information such as name and email address. We always provide a way to opt-out of these communications.

Transactions

Every time a transaction is made on the website a transaction email is sent to the account performing the transaction. If the user is identified as a minor, the transaction email should go to the parent or individual whose credit card and email address was used.

Service Announcement

On occasion it is necessary to send out a strictly service related announcement for all users. For instance, if our service is temporarily suspended for maintenance we might send users an email. However, these communications are not promotional in nature.

Special Offers and Updates

Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Choice/Opt-Out and Change/Modify section.

Choice/Opt-Out and Change/Modify

Our site provides users the opportunity to opt-out of receiving most communications from us. The user is currently provided an all-or-nothing option for receiving Service Announcements, Special Offers and Updates, and Newsletters. If the user chooses not to receive communications from us, then this site gives users the following options for removing their information from our database used in future communications. (There is no opt-out option for Transaction or Customer Service emails).

Our site also gives users the option for changing and modifying or removing information previously provided. Demographic information and sharing agreements can be changed in your User Profile settings via User Login. (click here, username and password required)

We will retain your data until requested, in writing, to delete such data from our records by the person or entity who created the account that contains such data and by the person or entity that purchased the products or services for which the data was collected.  We will retain and use your data as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

Changes to Privacy Policy

If we decide to change our privacy policy, we will post those changes to this privacy policy, the homepage at www.DrMaryKay.com, and other places to keep users aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will act in accordance with the privacy policy under which the data was acquired. If, however, we are going to use users’ personal, identifiable information in a manner different from that stated at the time of collection we will notify users via email. Users will have a choice as to whether or not we use their information in this different manner. However, if users have opted out of all communication with the site, or deleted/deactivated their account, then they will not be contacted, nor will their personal information be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on our Web site notifying users of the change prior to the change becoming effective. In some cases where we post a notice we will also email users, who have opted to receive communications from us, notifying them of the changes in our privacy practices.

Exceptions to Privacy Policy

While we are committed to keeping your information secure and private, we have the following exceptions to our privacy policy: We will release specific information about you or your account to comply with any valid legal inquiry or process such as a search warrant, subpoena, statute or court order. We will also release specific information in special cases, such as if there is an attempted breach of the security of the Sites, or a physical or property threat to you or others. We may also transfer user information, including personally identifiable information, in connection with a corporate merger, consolidation, the sale of related assets or corporate division or other fundamental corporate change. Further, the information you enter when making a purchase or an online donation will be shared with payment processors, financial gateways, and your credit card company to authorize credit card payments. Such information may also be shared with necessary third parties solely for the purpose or carrying out the transactions. Please note that if you give out personal information online through a discussion board or posting site about your Ultimate Leader Online program participation, that information can be collected and used by third parties. Although we strive to protect our users’ privacy, we cannot guarantee the security of information you post publicly in these or other forums. You disclose such information at your own risk.

Policy requesting to be taken off any lists of information that may be used for these purposes or that may be given or sold to third parties.

Please keep in mind that whenever you voluntarily make your personal information available for viewing by third parties online – for example on message boards, web logs, through email, or in chat areas – that information can be seen, collected and used by others besides us. We cannot be responsible for any unauthorized third-party use of such information.

Be aware that we may occasionally release information about our visitors when release is appropriate to comply with law or to protect the rights, property or safety of users of the Site or the public.

How We Store Your Information

Your information is stored at the list server that delivers our emails and data. Your information can only be accessed by those who help manage those lists in order to deliver e-mail to those who would like to receive communications and data from us.

All of the emails that are sent to you by us include an unsubscribe link in them. You can remove yourself at any time from our newsletters or mailing list by clicking on the unsubscribe link that can be found in every communication that we send you.

No Professional, Psychological or Medical Advice

The information contained in or made available through the Sites and the Ultimate Leader Online program are not medical or psychological tools.  Our program, assessments, and other products cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, financial, medical, psychological, or legal matters. We make no representations or warranties about any treatment, action, or medical or psychological benefit from following the information offered or provided within or through the Sites or from our programs, assessments, or other products. When using our products you release Ultimate Leader Online program, Dr. Mary Kay, and our partners, or any of their affiliates, from any direct, indirect, consequential, special, exemplary or other damages that may result, including but not limited to economic loss, injury, illness or death whether caused by negligence or any alleged negligence, on our part.  In using our products you agree to hold us harmless and not to attempt to hold us liable for any actions or results arising or claimed to arise from our products or services.

Children’s Privacy Statement

This children’s privacy statement explains our practices with respect to the online collection and use of personal information from children under the age of thirteen, and provides important information regarding their rights under federal law with respect to such information.

This Site is not directed to children under the age of thirteen and we do NOT knowingly collect personally identifiable information from children under the age of thirteen as part of the Site. We screen users who wish to provide personal information in order to prevent users under the age of thirteen from providing such information. If we become aware that we have inadvertently received personally identifiable information from a user under the age of thirteen as part of the Site, we will delete such information from our records. If we change our practices in the future, we will obtain prior, verifiable parental consent before collecting any personally identifiable information from children under the age of thirteen as part of the Site.

Because we do not collect any personally identifiable information from children under the age of thirteen as part of the Site, we also do NOT knowingly distribute such information to third parties.

We do NOT knowingly allow children under the age of thirteen to publicly post or otherwise distribute personally identifiable contact information through the Site.

Because we do not collect any personally identifiable information from children under the age of thirteen as part of the Site, we do NOT condition the participation of a child under thirteen in the Site’s online activities on providing personally identifiable information.
